1. General

a. Warranties: We warrant that the wines will be of satisfactory quality and fit for their general purpose.

b. Order acceptance and the completion of the contract between you and us will
take place on the despatch of the products ordered, unless we have notified you that we do not accept your order, or you have cancelled your order. Title will pass on delivery of the products, provided that we have processed and received payment in full for the products.

e. Availability - Wine is an agricultural product and runs out from time to time. If you order a case of wine and some of the products are out of stock we will replace them with equal value wines. We promise that we will only ever replace up to two bottles without asking.

f. Customer satisfaction - If you are dissatisfied with our performance in any way, please contact our customer services department immediately on 01325 329876. At Foxy Wine, we aim to deal with all enquiries fairly, confidentially, and quickly. We will acknowledge your contact within 24 hours. We try to resolve most issues immediately, but where this is not possible, we will keep you informed about progress until a satisfactory resolution has been achieved. 2. Age restriction


We will not sell wine to anyone who is not 18 years old or over. When you register your details, you will be required to enter a valid date of birth to confirm you are 18 years old or older. By placing an order, you also confirm that you are at least 18 years old.

b. If you are buying a case of wine as a gift - the recipient must also be over 18 years old.

c. Foxy wine operate an age verification policy. This is in line with the Challenge 25 Scheme. This is where the delivery driver may ask you to provide a suitable form of identification, such as Passport or UK Drivers Licence. This will be checked and photographed by the courier prior to the handover of any alcohol. If you are unable to provide this identification once requested the driver will not be able to make the delivery. Note: Alcohol will not be delivered to anyone who appears to be drunk.

3. Prices and payment

a. All prices are quoted in pounds sterling, and may be per product or per case, as marked. The prices include Value Added Tax, unless otherwise specified. Any delivery charges are additional.

b. We accept payment by Visa, MasterCard, Maestro, American Express, Apple Pay and Google Pay for single purchases.

c. Where a particular product is part of a pre-mixed case with a general discount applied, the discounted price for the case is relative to the non-discounted prices for the constituent wines.

d. We reserve the right to terminate any special offer at any time, without notice.


4. Delivery and returns

5. Where we deliver: Where we deliver: We will deliver your wine to anywhere in the United Kingdom
except for the Channel Islands (this does include Northern Ireland, the Highlands, Scottish islands, the Isle of Man, and the Scilly Isles).

6. Delivery timescales:

a. Standard delivery - Our delivery is £7.99 per order based on all orders above £47 in value to a single address. Standard delivery is 2-3 days from order.

b. Our courier delivers Monday to Friday between 8am and 5pm.

c. We shall not be liable for any delay in delivering your wine if that delay or failure is caused by circumstances beyond our control such as, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, fire, flood, storm or Act of God, failure of ISP or telecommunications provider in connection with the performance of this Agreement.

d. The following locations will be subject to an additional delivery charge. These are: The Highlands and Islands of Scotland - postcodes AB31, 33-38, 45, 52-56, FK17-21, IV, HS, KA27-28, KW, PA20-49, PA60-78, PH17-26, PH30-44,
PH49-50, ZE. Northern Ireland, Isle of Man, and Isles of Scilly - postcodes BT, IM, TR21-25. Isle of Wight. Central London congestion charge to postcodes commencing: EC1, EC2, EC3, EC4, SE1, SE11, SW1, W1, WC1
and WC2. We will contact you and make you aware of any additional charges prior to completing your order.

7. Spend over £100 and get Free Delivery


a. Customers qualify for Free Delivery when spending over £100 in a single transaction to a single address and is based on our Standard Delivery option.

b. If you select a different delivery option you will receive the cost of our Standard delivery (£7.99) deducted from your order and the difference will be charged.

8. Incorrect / missing or damaged products:


a. In the event that any of the products in your order are incorrect, missing, or damaged, please let us know within 14 days.

b. Where the order is a single product item we replace the item free of charge. Delivery of the replacement product should take place within 7 working days of you notifying us regarding the incorrect item.


9. Cancellations:
a. You may cancel your order for any reason whatsoever prior to date of dispatch.

c. Sorry to have to state the obvious, but once the wine has been delivered, in accordance with any specified delivery instructions, it becomes the recipient's responsibility.

d. Nothing in these Terms and Conditions will reduce your statutory rights relating to faulty or inaccurately described goods. Further information about your rights is available from your Local Authority Trading Standards
Department or Citizen's Advice Bureau.

e. We guarantee you will enjoy the wines you buy from us - so if you tell us that a wine was faulty, or you are not happy with the taste, we will replace that bottle free of charge with the same one or a suitable alternative of at least the same value as the wine you ordered. Please note that if you need to return your wines to us, we will arrange collection once you have contacted our offices.

g. Right To Terminate - This customer promise is here for the good of all of our customers. If we feel that it has been abused, we reserve the right to close your account, by inactivating it once we have met our obligations. If we do inactivate your account, and you choose to make another purchase, whether through that account or any other, then our obligation to you for any claim will be limited to your statutory rights and we will not be bound to deliver this customer promise.

11. If you have a voucher to redeem against the purchase of wine, the following terms and conditions apply, and you agree to be bound by these terms and conditions:

a. Promotional vouchers can only be used on orders of eligible wine cases containing 12 or more wine bottles.

b. You must be over 18 to redeem the voucher.

c. Vouchers are non-transferable, may not be sold at auction and have no cash alternative.

d. Gift Vouchers, e-cards and gift balances are valid for the period stated on the voucher.

a. If you are nervous about shopping on the web, do not be. We use secure payment partner Stripe’s technology for the transfer of credit card information.

14. Intellectual Property Rights

a. You agree and acknowledge that we own or are licensed to use all copyright, database rights, trade marks and other intellectual property rights in and to all parts of this web site, and to the business of Foxy Wine, the structure, design and layout of the web site and the styles of the wines.

b. You are entitled to use our web site in accordance with these Terms and Conditions only. You must obtain our prior written consent before you use our web site or any part of it in any other manner.

c. All persons, individual and corporate, are prohibited from providing hypertext or other links to the web site, other than to our home page, from their own web site or from a third party's web site, without our prior written consent.


15. Limitation of Liability

16. Nothing in these Terms and Conditions shall exclude Foxy Wine Online’ s liability for personal injury or death caused by its negligence.

17. We will not be liable for any loss or damage caused by us or our employees or
agents in circumstances where:

a. loss or damage was not foreseeable to both parties when the contract was formed.

b. loss or damage was not caused by any breach on the part of the supplier.

c. loss or damage relates to business and/or non-consumers.

18. Subject to Clause 10a we will not be liable for loss or damage caused by the customer handling of our products. In particular we will not be liable for spillages or breakages.

19. Customers should also be aware of the following inherent risks and warnings: a. Alcohol should be consumed in moderation.

b. A case of wine is heavy so extra care should be taken when lifting it. If you are concerned about the weight we advise that you transfer the bottles 1 or 2 at a time.

c. Red wine in particular may cause staining if spilled so extra care should be taken.

d. Sparkling wines and champagnes can be volatile due to the build-up of gases, extra care should be taken when opening these.
